Overview

The Community Right-to-Know Law [Local Law 26 of 1988], requires NYC to effectively regulate the storage, use, and handling of hazardous substances. Through the Right-to-Know (RTK) program, the use and storage of hazardous substances that pose a threat to public health and the environment are managed.

The RTK Program required businesses and facilities to annually file a Tier II report detailing the quantity, location, and chemical nature of every hazardous substance stored within the building and its grounds throughout the five boroughs.

 

4.10.1. Filing

RTK uses an online reporting system that allows the facilities to electronically submit their Annual, Revision, or Updated Tier II Submissions. Facilities can choose to pay online using an electronic check or credit card.

The annual filing deadline is March 1st for the previous calendar year. Penalties for violations of Section 312 of SARA Title III can reach up to $27,500 for each violation. Fines add up quickly because each day a violation continues to exist, constitutes a separate violation.

The Tier II report captures information about the types, quantities, and locations of hazardous chemicals at a given facility. The form also lists contact information for the facility’s designated emergency point-of-contact.
